Apprehending arrest in connection with Salboni Police Station Case No. 269 of 2019 under Sections 345/323/325/307/506/34 of the Indian Penal Code, the petitioners have filed the instant application for anticipatory bail under Section 438 of the Code of Criminal Procedure.

It is submitted by the learned Advocate appearing for the petitioners that they have been falsely implicated in the present case. The dispute was over a destruction of mustard field, adjacent to which the complainants went for a picnic.

On the other hand, the learned Advocate for the State opposes the prayer for anticipatory bail and submits that the charge sheet has already been submitted.

Having heard the submissions so advanced by the respective parties, perused the materials available in the case diary and having regard to the nature of injury, we are of the opinion that the petitioners should be entitled to get the privilege of anticipatory bail, as the charge sheet has already been submitted. In the event of arrest the petitioners shall be released on bail on furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer of the concerned police station with condition that the petitioners shall meet the Officer-in-Charge of the concerned

police station in every fortnight with further condition that they shall attend on each day when the matter would be fixed before the learned Sessions Judge and in default, the learned Sessions Judge will be at liberty to cancel the anticipatory bail granted by this Court and with further conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

The application for anticipatory bail, being CRM 11018 of 2020, is thus allowed.
