CAN 1 of 2021 has been filed by the Staff Selection Commission, Government of India seeking recall of the order dated 11.01.2021.

Across the bar, counsel for the Staff Selection Commission submits that the Staff Selection Commission is not desirous of seeking recall of the entire order and prays for only modification thereof. It is submitted that the Staff Selection Commission does not conduct the medical examination of any person but the same is conducted through the Medical Board of the Authorities for whom recruitment is proposed to be made. It is also submitted that D. I. G., Recruitment, B. S. F. is the authority to conduct the medical examination. It is further submitted that the B. S. F. has already fixed today for receiving the documents of the petitioner for scrutiny. The Medical Re-examination is supposed to occur tomorrow.

In view of the above, the order dated 11.01.2021 is modified to direct the D. I. G., Recruitment, B. S. F. to conduct the Review Medical Examination as is already underway.

The communication dated 08.03.2021 addressed to the petitioner by the Assistant Commandant (MIN/ESTT), FTR HQ BSF, South Bengal may be kept with the record.

With the aforesaid observations, the CAN 1 of 2021 and the writ petition are disposed of.

No order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
