CRM 11023 of 2020 In re: An application for bail under Section 439 of the Code of Criminal Procedure,1973 in connection with Chandrakona Police Station case No. 163 of 2020 dated 01.07.2020 under Section 420/406 of the Indian Penal Code.

Ms. Faria Hossain, Ms. Sonali Das ... for the State Having heard the learned advocate for the for the petitioner and the learned P.P.-in-Charge and on perusal of the materials on record as well as the case diary, it is ascertained that petitioner took huge amount of pesticides and manure etc. from one Santosh Mondal amounting to Rs. 1,74,990/- but did not pay the said amount to Santosh.

The petitioner is in custody for about 55 days. It is found from the case diary that most of the witnesses have already been examined and their statements were recorded under Section 161 of the Code of Criminal Procedure.

Therefore, I am of the view that for the purpose of further investigation, detention of the accused is not necessary. Accordingly, the accused may find bail of Rs. 20,000/- with two sureties of Rs. 10,000/- each, one of whom must be local surety to the satisfaction of the learned Additional Chief Judicial Magistrate, Ghatal, Ghatal , Paschim Medinipur with further condition that

if on bail , he shall meet the Investigating Officer once in fortnight till the completion of investigation. He also furnish his residential address to the Investigating Officer by swearing on affidavit on the first date of his visit. He will not induce or threaten the witnesses of this Court in any manner during investigation and trial of the case. If the petitioner violates any of the conditions mentioned hereinabove , the order of bail shall be cancelled without further reference to this Bench. Case Diary be returned.
