Sk Salam v. State Of West Bengal And ORS.
(Through Video Conference) 13.08.2021 serial no. 100 D d WPA 11388 of 2020 Sk Salam Vs.
The State of West Bengal & Ors.
Mr. Debasis Sur Mr. Mrinmoy Chatterjee, Advocates ... ... for the Petitioner Sk. Md. Galib Ms. Subha Nag, Advocates ... ... for the State The grievance of the petitioner is that despite a complaint being lodged with the police disclosing commission of cognizable offences, the police did not act thereon.
Learned advocate appearing for the State submits that police on inquiry found that no offence was committed and, therefore, submitted a report of non-cognizable offence There is an injury report annexed to the writ petition which discloses that the petitioner suffered injury. Therefore, it is hard to accept that no cognizable offence occured in the incident.
Consequently, the police will register the complaint of the petitioner as a First Information Report and will conduct investigations thereon in accordance with law.
With the aforesaid direction, WPA 11388 of 2020 is disposed of.
