The grievance of the petitioners is that pursuant to a representation filed by them before the Chairman, Rehabilitation Advisory Committee and ADM, Haldia, it was observed by the authority in an order dated 30th May, 2019 that "the Chairman, Rehabilitation Advisory Committee, Haldia has no power to recommend rehabilitation plot for acquisition of land in favour of Haldia Municipality". The petitioners, accordingly, approached the Haldia Municipality for consideration of their prayer for allotment of rehabilitation plot in their favour, on 19th August, 2020. The said representation has not been disposed of as yet.

Having heard the submissions made on behalf of the parties and considering the material on record, I dispose of the writ petition with a direction upon the respondent No.10 to consider and dispose of the representation filed by the petitioners within a period of two months from the date of communication of this order and after giving reasonable opportunity of hearing to all the affected parties including the petitioners, in accordance with law.

Accordingly WPA 11391 of 2020 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
