Apprehending arrest in connection with Domkal P.S. Case No. 555 of 2020 under Sections 448/376/511/323 of the Indian Penal Code, the petitioner has filed the instant application for anticipatory bail under Section 438 of the Code of Criminal Procedure.

The learned Advocate for the petitioner submits that the petitioner has been falsely implicated in the present case. There is a civil dispute over a drainage in the premises of the petitioner.

The learned advocate for the State opposes the prayer for anticipatory bail.

Having regard to the statement made by the victim under Section 164 of the Code of Criminal Procedure and also the medical report, prima facie, disclosing complicity of the petitioner in the alleged crime, we do not feel that the

petitioner should be given the benefit of anticipatory bail, as the investigation is still at the early stage. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
