The petitioner claims that she was a beneficiary under the Pradhan Mantri Abas Yoyana (PMAY) for the year 2017. It is submitted that another person bearing the same name as the petitioner, has impersonated her and has withdrawn the said some of money.

The B.D.O, Kulpi has filed a report. It appears that hearings were held on July 5, 2021 and July 9, 2021 asking the petitioner to produce her documents of identity. It is submitted that the petitioner has not produced the same. Counsel for the petitioner, however, denies such allegation. Be that as it may, this Court directs the B.D.O to hold a fresh hearing on the claims of writ petitioner on December 22, 2021 at 11.00 A.M, the writ petitioner shall produce all documents of identity including a photo identity card recognized by the Government.

Upon receipt of such documents the B.D.O will pass suitable orders. Needless to mention that the petitioner shall

also be entitled to file a formal complaint with the Dholahat Police Station in this regard and upon receipt of any complaint the Officer-in-Charge, Dholahat P.S. shall register FIR, conduct appropriate investigation and file report in accordance with law before the jurisdictional magistrate. In view of the above, the writ petition is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
