I have heard counsel appearing on behalf of the petitioner, the State respondents, the West Bengal Board of Secondary Education and West Bengal Central School Service Commission.

It appears that out of the choice of the petitioner for being recommended as Headmaster to three of the schools, the vacancy for the post of Headmaster in Dubra Adarsha Vidyamandir has been sent to the Commissioner of School Education, West Bengal vide Memo No.02/VS/18 dated July 4, 2018.

Counsel appearing on behalf of the West Bengal Central School Service Commission submits that if the statement of vacancy is sent to the West Bengal Central

School Service Commission (hereinafter referred to as 'Commission'), the Commission can thereafter issue recommendation in favour of the petitioner for the post of Headmaster in the said school.

In light of the above, the Commissioner of School Education is directed to forward the statement of vacancy to the Commission within a period of two weeks from date and thereafter, the Commission is directed to send the recommendation in favour of the petitioner for the post of Headmaster in Dubra Adarsha Vidyamandir within two weeks of receipt of the same from the Commissioner of School Education to the West Bengal Board of Secondary Education. Thereafter, Board is directed to issue appointment of the petitioner within two weeks of receipt of the recommendation from the West Bengal Central School Service Commission.

With these observations, this writ petition stands disposed of.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
