Versus

State Bank of India and others Mr. Biswapriya Samanta ...for the petitioner Mr. Subrata Kumar Sinha ... for the respondents.

Counsel for the petitioner submits that his client went to join her duties after some absence but she was not allowed to do so. There is a letter dated 14.12.2020 issued by the Branch Manager, State Bank of India, Panchkhuri Branch stating that since the petitioner has absented herself since 16.01.2019, she had voluntarily vacated her employment on 12.12.2020.

Counsel for the petitioner submits that his client went to join duties on 12.11.2020 but was prevented from doing so.

Counsel for the bank submits that the petitioner may join her duties any time.

Hence the petitioner shall be entitled to join her duties in the post of Customer Assistant at Panchkhuri Branch, State Bank of India within seven days from date.

The bank shall be entitled to take all steps in accordance with bipartite settlement and applicable law against the petitioner. The petitioner shall be entitled to take out any proceeding and/or defend any proceeding by the bank against her in accordance with law.

In view of the aforesaid order, the letter dated 14.12.2020 shall stand quashed and set aside.

With the aforesaid observations, the instant writ petition is disposed of.

Since no affidavit in opposition has been used by the State Bank of In India, the allegations made in the writ petition shall not be deemed to have been admitted.

Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
