For the State Counsel for the petitioner is aggrieved by the fact that despite complaint having been registered with the Narendrapur Police Station as regards alleged forcible occupation of the petitioner's land on 14th October, 2020 no action has been taken.

By further complaint dated 21st October, 2020 the Superintendent of Police, Baruipur Police District, Kolkata 700144 was also notified by the petitioner.

The grievance of the petitioners relates to illegal and unauthorised occupation of land by the private respondents and illegal construction there at. The petitioners have also expressed fear of threat to their life and person.

Having heard the private respondents this Court notes that the dispute between the parties is primarily civil in nature

and the police cannot determine as to who has been in the possession of the property in question.

The petitioners may therefore seek civil remedies in that regard. However in so far as the threat to the petitioner's life and person is concerned, the Officer-in-Charge, Narendrapur Police Station shall ensure that there is no breach of peace in the said area and shall take appropriate steps in the event of any further complaint is made.

With the aforesaid observation, WPA 11470 of 2020 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
