S. Case No. 28 of 2020 dated 26-02-2020 under Section 21(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 pending before the learned Additional Sessions Judge cum Judge Special Court, Hooghly(In Charge).

Mr. Saswata Gopal Mukherji, PP Mr. Arijit Ganguly ....for the State. The report so called for has been submitted by the S.I of Police, Rishra P.S through the learned advocate for the State. Let the same be kept with the record. The record reflects that supplementary chargesheet has already been filed before the learned court which includes the Chemical Examiner's report. The petitioner is aggrieved by the fact that there has been no progress in the case although he is in custody for about 11 months.

It has been submitted that the next date is fixed on 16.01.2021. In view of the fact that the supplementary chargesheet has already been submitted along with the Chemical Examiner's report, the learned trial court after supply of copies at least proceed with the stage of consideration of charge. The learned trial court should take efforts for completing the trial within a reasonable period of time. No time schedule is fixed for the present. However, the learned trial court would keep in mind the spirit of Article 21 of the Constitution of India while disposing of such cases. With the aforesaid observations, CRR 1880 of 2020 is disposed of.
