Mr. Mukteswar Maity, Ms. Manika Sarkar ...for the petitioner Ms. Prisanka Ganguly ...for the WBSEDCL The limited prayer of the learned counsel for the petitioner is for consideration of the representation of the petitioner, annexed at pages 23 and 24 of the writ petition, with regard to consideration of the demand for the due amount by the Distribution Licensee from the petitioner.

In view of the innocuous nature of the prayer, there is no necessity at present to refer the matter to the concerned Grievance Redressal Officer, more so, since the Distribution Licensee has apparently communicated to the petitioner in writing on December 16, 2021, a copy of which is annexed to the supplementary affidavit, that

the representation of the petitioner has been forwarded to the higher authority for further consideration.

Such supplementary affidavit be kept on record. A copy of the said supplementary affidavit is served on the learned advocate for the Distribution Licensee here and now.

W.P.A. No. 11528 of 2020 is, thus, disposed of by directing the Distribution Licensee/respondent to consider the representation of the petitioner, as appearing at pages 23 and 24 of the writ petition, as expeditiously as possible, preferably within three weeks from date and to intimate the outcome to the petitioner at the earliest thereafter.

If need be, the Distribution Licensee shall be at liberty to permit the petitioner to be heard and produce relevant documents in respect of the representation for the purpose of such adjudication.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
