The petitioner does not want to proceed with the writ petition.

The allegation of the petitioner was that the Howrah Municipal Corporation had not taken any steps against the unauthorised construction raised by the respondent Nos.6 to 8. Today, a letter written by the writ petitioner to his learned Advocate-on-record has been handed over indicating that the petitioner does not want to proceed with the writ petition.

The writ petition is dismissed for non-prosecution. However, as the writ petition is dismissed as not pressed, the issues with regard to the unauthorised construction has not been decided by this court. Such point is left open and this order shall not bar any action by the corporation.

There will be, however, no order as to costs. (Shampa Sarkar, J.)
