For the Petitioner Mr. Saibal Bapuli Mr. Arani Bhattacharya .....For the State This is an application under Section 439 of the Code of Criminal Procedure filed on behalf of the petitioner who is in jail custody for the last 87 days praying for release on bail in connection with the case which has been initiated at the instance of the sister of the victim girl.

I have heard the learned counsel appearing for the petitioner and Mr. Saibal Bapuli, learned counsel appearing for the State.

Learned counsel for the petitioner/accused submits that Neha and Sandip Patra called the victim girl for bridal shoot on 10.07.2020 and that there has been delay of about 15 days in filing the First Information Report on 28.07.2020 as the date of offence alleged is on 13.07.2020. It is further submitted that the petitioner in no way involved in the crime alleged.

The application for bail has been opposed by learned counsel for the State and submits that the petitioner is the main accused of the crime who gives shelter to the parties for obscene video filming. My attention is invited to the statement of the victim girl recorded under Section 164 of the Criminal Procedure Code and also the statement of a neighbour.

Having regard to the statement of the victim girl and other materials of the C.D, the prayer for bail is rejected. Thus, the application being, CRM 11118 of 2020 is disposed of.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of the requisite formalities.
