In this revisional application, the petitioner/plaintiff in Title Suit No.298 of 2014 has prayed for expeditious disposal of the application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure.

It is submitted on behalf of the petitioner that the written objection to the said application has been filed by the contesting defendants and the application was ready for hearing.

Records reveal that the application for injunction has been pending since 2014 and the ad interim order has been extended from time to time but the main application has not been heard out.

Without going into the merits of the claim and counterclaim of the parties and without making any observation with regard to the facts of the case, this revisional application is disposed of with a direction upon the learned Civil Judge (Junior Division), Bidhannagar, North 24-Parganas

to hear out and dispose of the application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure upon affording an opportunity to all the contesting parties. It is expected that the said application shall be disposed of preferably within a period of one month from the next date fixed. The learned Advocate-on-record for the petitioner is directed to serve copies of this revisional application upon the contesting opposite parties along with a server copy of this order within a period of seven days.

This revisional application is, thus, disposed of. There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
