The present application under Section 438 of the Code of Criminal Procedure, 1973 filed at the instance of Sanjoy @ Sonjay Pahan is taken up for hearing and order.

It is submitted on behalf of the petitioners that they have been falsely implicated in this case and no offence as alleged has been committed by them.

The State opposes the prayer for anticipatory bail and refers to the statement of witnesses in the case diary. It appears from the case diary that sufficient incriminating material has transpired against the petitioners during investigation. The petitioners are the principal accused. Considering the nature of offence, we are not inclined to grant anticipatory bail.
