And In the matter of:- Manglu Mandal.......petitioner Mr. Kalidas Saha.............for the petitioner Mr. Abhra Mukherjee Mr. Goutam Banerjee ..for the State The present application under section 438 of the Code of Criminal Procedure filed at the instance of Manglu Mandal is taken up for hearing and order.

It is submitted on behalf of the petitioner that there is a long standing civil dispute between the parties which led to the present complaint. Other accused standing on the same footing has been granted anticipatory bail earlier.

The State produces the case diary and opposes the prayer for bail.

It appears that there was a free fight. Other co-accused similarly circumstanced with the petitioner has been granted anticipatory bail earlier. Injuries sustained by the victims are not

serious or life threatening. In the circumstances, we are inclined to grant anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest the petitioner shall be released on anticipatory bail upon furnishing bond of Rs. 10,000/- (Rupees Ten Thousand) only with two sureties of like amount to the satisfaction of the arresting officer and also subject to the conditions as laid down under section 438 (2) of the Code of Criminal Procedure, 1973.

The application for anticipatory bail is, accordingly, allowed. C.R.M. 11171 of 2020 is disposed of.
