The competent authority, the respondent no.

1 herein, by a notification declared a portion of the purchased land of the petitioners comprised in Dag Nos. 2942, 3514, 2940, 3513 under Mouza-Parui, J.L. No. 3, Police Station Behala, District 24-Parganas (South) as vested land of the State being the land in excess of ceiling limit prescribed under the Urban Land (Ceiling and Regulation) Act, 1976.

The petitioners on July 03, 2017 gave a representation to the respondent no. 1 disputing the veracity of the aforesaid notification and

prayed for issuance of a no-objection certificate in their favour.

The grievance of the petitioners is that the hearing on the said representation although has commenced but has not yet been concluded.

To resolve the said grievance of the petitioners, the respondent no. 1 is directed to dispose of the said representation dated July 03, 2017 appearing at page 84 of the writ petition being annexure "P-9" by a reasoned order in accordance with law by the end of the month of July 2021 after giving an opportunity of being heard to the petitioners.

The petitioners are directed to communicate this order to respondent no. 1 within a week from date.

Since no affidavit-in-opposition has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

W.P.A 11694 of 2020 is disposed of with the above terms. There shall be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Biswajit Basu, J.)
