Sarwar Jahan Mr. Anisur Rahaman .. for the petitioners Mr. Neguive Ahmed Ms. Amita Gaur Ms. Manisha Sharma ..for the State The present application under section 438 of the Code of Criminal Procedure filed at the instance of Yearul Sk. @ Ira and another is taken up for hearing and order.

It is submitted on behalf of the petitioners that they were falsely implicated in the case due to political rivalry. State produces the case diary and refers to statement of witnesses in opposing the prayer for anticipatory bail. It appears from the case diary that both the petitioners were found to have been carrying guns and incriminating materials have transpired against them during investigation. Considering the nature and gravity of the offence, we are inclined to hold that custodial interrogation of the petitioners may

be required for the purpose of investigation. Accordingly, their prayer for anticipatory bail is rejected.

C.R.M. No.11182 of 2020 is disposed of.
