The present application under Section 438 of the Code of Criminal Procedure, 1973 filed at the instance of Rahamat Ali Mallick & Ors. is taken up for hearing and order. It is submitted on behalf of the petitioner that they are father-in-law and brothers-in-law of the victim and have been falsely implicated in this case due to family dispute. The State opposes the prayer for bail and refers to injury report as well as statement of the victim under Section 164 of the Code of Criminal Procedure.

It appears that the victim sustained acid burn injuries and there is prima facie material against the petitioners suggesting their active involvement in the alleged offence.

Considering the gravity of the offence, prayer for anticipatory bail is rejected.

CRM 11194 of 2020 is disposed of.
