In the matter of :- Prasanna Ghosh Mr. Amitabha Karmakar Mr. Dhananjay Banerjee Mr. Arup Kumar Bhowmick ....for the petitioner Mr. Imran Ali Ms. Manasi Roy ...for the State This is an application praying for stay of a warrant of arrest issued against the petitioner in a trial under Sections 363, 366 and 368 of the Indian Penal Code. Let a copy of this application be served upon Mr. Imran Ali and Ms. Manasi Roy, learned advocates, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner had obtained bail and was regularly attending the learned Trial Court. During pendency of the proceeding, a compromise and settlement was arrived at between the victim and the accused petitioner. In fact, the petitioner got married to the victim after she turned major. The couple even had a

child. As the petitioner was not aware of the intricacies of a criminal trial, he stopped attending the Court. Accordingly on 1st July, 2019, a warrant of arrest was issued against the petitioner, which has remained pending.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. In view of the above and in the interest of justice, I direct that the warrant of arrest issued against the petitioner shall remain stayed for a period of four weeks from this date. The petitioner shall surrender before the learned trial Court within the said period of four weeks. In the event the petitioner surrenders before the learned trial Court within such time and prays for bail, the application for bail shall be considered in accordance with law.

With these observations, the revisional application is disposed of.
