In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A. 11776 of 2020 Bandana Pan & Ors.

-versus The State of West Bengal & Ors.

Mr. Samiran Mandal.

...For the Petitioners.

None appears on behalf of the respondents.

The petitioners submit that in response to an advertisement for appointment in the post of Anganwadi Karmee and Helper under the Child Development Project Officer, Taldangra, DistrictBankura in the year 2009 the petitioners participated for appointment as Helper.

According to the petitioners, a panel was published but thereafter, the same was never approved by the competent authority.

A further advertisement was published in the year 2019 and appointment was sought to be made pursuant to the subsequent advertisement.

The petitioners are aggrieved by the same.

It has been submitted that the cancellation of the earlier advertisement was not intimated to the petitioners.

The petitioners annexed a representation dated 12th October, 2020 made by the learned advocate on behalf of the petitioners.

The present writ petition has been filed as the said representation made on behalf of the petitioners was not taken up for consideration.

From the submissions made on behalf of the petitioners, it appears that the advertisement which the petitioners are presently challenging was published in the year 2019.

The petitioners have filed the present writ petition on 24th December, 2020.

The representation though dated 12th October, 2020 was actually served upon the Panchayat Samity on 6th November, 2020.

It appears that the petitioners have failed to approach this Court in the right time.

In the year 2022, the Court ought not to disturb the selection process which was initiated by the advertisement dated 20th October, 2019 for recruitment of Anganwadi Helper.

In view of the above, no relief can be granted to the petitioners at this stage in the instant petition. The writ petition fails and is hereby dismissed.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
