The present application under Section 438 of the Code of Criminal Procedure, 1973 filed at the instance of Liton Dey & anr. is taken up for hearing and order.

It is submitted on behalf of the petitioners that the petitioners are the husband and mother-in-law and they have complied with the notice under Section 41A of the Code of Criminal Procedure, 1973. Streedhan articles have also been seized by the investigating officer.

The State refers to the case diary and opposes the prayer for anticipatory bail.

It appears that the petitioners are the husband and mother-in-law of the defacto complainant. Streedhan articles have been seized.

Considering the nature of allegations as well as the extent of complicity of the petitioners in the alleged crime, we are inclined to

grant anticipatory bail to the petitioners.

Accordingly, we direct that in event of arrest, the petitioners shall be released on anticipatory bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand) only each with two sureties of like amount each to the satisfaction of the arresting officer and also subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.

The application for anticipatory bail is, accordingly, allowed.

C.R.M. 11219 of 2020 is disposed of.
