For the Respondent CAN 1 of 2021 (Substitutiion) After hearing the learned advocate for the respective parties and upon consideration of the averments made in the application that the sole respondent died on September 20, 2020 leaving behind him surviving the heirs, as specifically mentioned in paragraph of the said application, and also that the said heirs are majors, suijuris and of sound mind, we allow the application for substitution being CAN 1 of 2021. The heirs of the deceased respondent, as specifically mentioned in paragraph 4 of the said application, be substituted in place and stead of the deceased respondent.

The department is directed to amend the cause title of the instant writ petition within period of two weeks from date.

WPCT 73 of 2020 The writ petition is taken up for immediate consideration with the consent of the parties by treating the same as on the day's list.

The instant writ petition stands disposed of in terms of the order dated 15th July, 2021 passed in similar matters being WPCT 71 of 2020, WPCT 72 of 2021, WPCT 77 of 2020, WPCT 78 of 2020 and WPCT 79 of 2020.

Mr. Chiradip Sinha, learned advocate, has been authorised to represent the substituted heirs of the deceased respondent and in this regard he undertakes to file Vokalatnama within two weeks from date.

WPCT 73 of 2020 is thus disposed of without any order as to costs.

Urgent photostat copy of this order, if applied for, be given to the parties upon compliance of all formalities.
