Shikha Rani Jana And ORS v. The State Of West Bengal And ORS
04.07.2022 d.p.
In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A. 11847 of 2020 Shikha Rani Jaja & Ors.
-versus The State of West Bengal & Ors.
Mr. Uttam Kumar Bhattacharryya, Mr. Kaustav Mishra.
...For the Petitioners.
Mr. Swapan Kumar Datta, Mr. Tapas Kumar Dey.
...For the State.
Affidavit-of-service filed in Court today is taken on record.
The petitioners are aggrieved by the order communicated to the petitioners on 2nd June, 2020 whereby the petitioners were found entitled to receive interest on account of delayed payment of family pension in their favour on and from 20th May, 2018 till the date of actual payment.
The petitioner No.1 happens to be the widow of the deceased employee. The rationale behind making payment in favour of the petitioiner no. 1 with interest from 20th May, 2018 is clearly mentioned in the order impugned.
All the dates which have relevant for the purpose of taking a decision in the matter have been mentioned.
The authority concerned has already applied its mind and directed payment of all the dues along with interest @7% per annum on and from 20.05.2018 till the date of actual payment.
In the opinion of the Court, the rationale in passing the impugned order appears to be justified. No interference is called for.
The writ petition, accordingly, stands dismissed. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
