For the State The present application under section 438 of the Code of Criminal Procedure, 1973 filed at the instance of Jadunath Mazumder is taken up for hearing and order. It is submitted on behalf of petitioner that he is a mere employee of a jewellery shop who value gold pledged with the bank for the purpose of loan. Co-accused have been granted bail earlier.

The State produces the case diary and refers to the statement of witnesses in the case diary. The State further submits that the petitioner is the gold valuer who at least on one occasion certified genuineness of the gold pledged with the bank and part of the certified gold turned out to be fake.

It appears that the petitioner is the principal accused and incriminating material has transpired against him

during investigation. In the facts and circumstances of the case, we are inclined to hold that custodial interrogation of the petitioner may be required for the purpose of effective investigation of the case. Accordingly, the prayer for anticipatory bail is rejected.

CRM 11256 of 2020 is disposed of.
