29.12.2020 rrc CRM 11280 of 2020 (via Video Conference) In re : An application for bail under Section 439 of the Code of Criminal Procedure in connection with Digha PS Case No. 19 of 2020 dated 02.06.2020 under Sections 302/201 of the Indian Penal Code.

In the matter of : Sk. Sabir ..... petitioner Mr. Indrajit Chatterjee ....For the petitioner Mr. Swapan Banerjee Ms. Purnima Ghosh .....For the State We have considered the materials on record involving the unnatural death of the victim lady. The victim lady is the second wife of the petitioner and was married to the petitioner for about 13 years. The petitioner is in custody for 182 days and chargesheet has been filed on 9th August, 2020. The 164 statement makes it clear that the petitioner died an unnatural death. The petitioner, being the sole accused for the offence, is hence required for custodial interrogation. It has also been submitted on behalf of the State that the date for evidence in the matter is fixed on 8th January, 2021. Having regard to the above circumstances, we are not inclined to release the petitioner on bail.

CRM 11280 of 2020 is, accordingly, rejected.
