(DISPOSED OF) Mr. Tapas Kumar Dey, Advocate Mr. Ashis Kumar Dutta, Advocate ......for the Petitioner The grievance of the petitioner in this writ-petition is that the concerned police have registered the case only under Sections 498A/304B/34 of the Indian Penal Code. According to the petitioner, the police ought to have added Section 406 of the Indian Penal Code and Sections 3 & 4 of the Dowry Prohibition Act in the F.I.R. since the complaint before the police authority discloses the offences under the said sections also.

Investigation is in progress.

If during the investigation the ingredients of the offences under Section 406 of the Indian Penal Code and Sections 3 & 4 of the Dowry Prohibition Act are found, it will be open to the police to add those sections in the chargesheet. With these observations, the writ-petition being WPA 11909 of 2020 is disposed of.
