The writ petitioner claims that the private respondents are disturbing his possession notwithstanding a decree in T. S. No. 62 of 1993 passed by the Civil Judge(Junior Division), 2nd Court at Hooghly.
Counsel for the private respondents submits that there is a Title Appeal being Title Appeal No. 25 of 2021 and also another appeal being S. A. No. 267 of 2009 pending before this Court.
Until disposal of the civil proceedings between the parties, the O. C. Pandua Police Station shall ensure that there is no breach of peace in the area.
The instructions of the O.C., Pandua Police Station addressed to State advocate is taken on record.
With the aforesaid observations, the writ petition is disposed of.
There will be no order as to costs.
