The writ petitioners are aggrieved by the fact that despite complaint, Baguiati Police Station has not taken any steps against the private respondents for obstructing common passage being used by the writ petitioners.
Admittedly, a civil suit is pending between the parties in which injunction has been ordered by the learned Civil Judge (Junior Division) 1st Court at Barasat, North 24 Parganas in the said civil suit. In so far as the alleged inaction on the part of the police is concerned, this Court notes a complaint annexed to the writ petition that the same in fact does not call for any intervention by the police.
However, since the petitioners complain of physical threat from the private respondents, the
Officer-in-charge, Baguiati Police Station shall ensure that there is no breach of peace in the locale and shall continue to maintain strict vigil thereat. The Officer-incharge, Baguiati Police Station shall also, immediately after receipt of the complaint, attend to any complaint from any of the parties in this regard.
With the aforesaid directions, the instant writ petition shall stand disposed of.
There will be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
