The Investigating Officer of Hare Street Police Station Case No.

dated 13.12.2020 under Sections 193/199/200/209/418/406/465/466/467/468/471/120B of the Indian Penal Code has filed a report pursuant to the order dated 29th April, 2022. The report encloses the statement of the de facto complainant. I find that the statement of one Sailesh Agarwal has been enclosed along with the report, which was recorded by the Investigating Officer of the case. In such statement, the opposite party no. 2/de facto complainant has stated that he was illegally removed from the Directorship of the Company, but subsequently after an amicable settlement, he has been reinstated to his former assignment/designation. As such, he do not intend to pursue with the

litigation which was registered by way of Hare Street P. S. Case No. 269 of 2020 dated 13.12.2020.

Let the report dated 12th May, 2022 so submitted by the I. O. of the Hare Street Police Station be kept with the record. Having regard to the fact that the differences and disputes which arose and which led to the registration of the particular case is a private and personal dispute and no public policy is involved, the further continuance of the same is unwarranted because of the amicable settlement arrived at between the parties. Accordingly, Hare Street Police Station Case No. 269 of 2020 dated 13.12.2020 is, hereby, quashed.

Thus, the revisional application being CRR 1944 of 2020 and the connected application being CRAN 1 of 2022 are allowed. All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby made absolute. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
