as (Rejected) C.R.M. 12 of 2020 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure filed on 18.12.2019 in connection with Samuktala P. S. Case No.158 of 2019 dated 28.06.2019 under Sections 498A/302/304B of the Indian Penal Code. In the matter of : Majirul Alam @ Haque @ Bhuttu. ... Petitioner.

Mr. Arnab Saha.

...for the Petitioner.

Mr. Rana Mukherjee, Ms. Sujata Das.

...for the State.

Heard the learned Counsels appearing on behalf of the parties. It is submitted on behalf of the petitioner that he is in custody for about 186 days. Petitioner also attempted to commit suicide after the occurrence.

Learned Advocate appearing for the State opposes the prayer for bail and submits that the petitioner had strangulated his wife resulting in her death.

Having considered the materials on record disclosing prima facie involvement of the petitioner in murdering his wife, we are of the opinion that in view of the gravity of the offence this is not a fit case to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

Trial court is requested to commit the case to the Court of Sessions at the earliest without granting unnecessary adjournment to either of the parties.
