Puspa Modok) (Vio Video Conference) Mr. Narendra Nath Das Mr. Shyamal Barman ....For the petitioner The petitioner is aggrieved by an order passed by the Civil Judge (Jr Divn), Mathabhanga on 16th September, 2020 by which the petitioners' electricity connection over the suit property was directed to be disconnected within a period of 15 days from the date of the order. The petitioner is the defendant in the suit filed by the plaintiff/opposite party in the present proceedings. Since this Court has been informed that the next date of hearing before the learned court below is 24th February, 2021, this Court is not inclined to make an order of reconnection of electricity as has been prayed for by the learned counsel for the petitioner as the petitioner is without the electric connection since September, 2020 and order for reconnection can only be passed upon hearing the opposite party who is not represented in the present proceedings.

Learned Civil Judge (Jr. Divn.) is, however, directed to consider the prayer of the petitioner (defendant before the learned court below) for

reconnection of electricity supply on the next date of hearing.

C.O. 1 of 2021 is disposed of in terms of the above.
