Records reflect that the petitioner has challenged the order dated 25.09.2024 passed by the learned Judicial Magistrate, 4th Court, Siliguri in connection with Misc. Case No. 36 of 2021. Subject matter of the said order relates to dismissal of an application under Section 340 of the Code of Criminal Procedure.

Having considered that a separate provision exists in respect of dismissal of an order under Section 340 of the Code of Criminal Procedure, I am of the opinion that the present revisional application is not maintainable. Petitioner would be at liberty to prefer before the Appellate Forum of the learned Judicial Magistrate, if so advised.

Accordingly, CRR 2 of 2025 is dismissed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
