And In Re : Suraj Hossain ..... petitioner Mr. Subhasish Misra ... for the petitioner Ms. Zareen N. Khan Ms. Trina Mitra ... for the State Petitioner is in custody for 772 days. He renews his prayer and it is submitted by the learned Counsel appearing for the petitioner that there is slow progress in trial of the case.
Learned Counsel appearing for the State opposes the prayer for bail and submits that trial has substantially progressed and the eyewitnesses have identified the petitioner. His prayer for bail was rejected earlier.
Having considered the materials on record. There are sufficient materials connecting the petitioner with the murder of the victim. Trial is in progress and witnesses have identified the petitioner. His prayer for
bail was rejected earlier. Under such circumstances, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected. However, in view of protracted period of detention suffered by the petitioner, we request the trial court to conduct the trial as expeditiously as possible and concluded the same at an early date without granting unnecessary adjournment to either of the parties.
