Counsel for the respondent is present. By an order dated 3rd March, 2022, the matter was referred to the Mediator and by an order dated 15th June, 2022, the Mediator has submitted the report wherein the Mediation fails. After the submission of the mediation report, it is found from the record that the matter was listed on 5.4.2023 but none appears on behalf of the petitioner. Again the matter was listed on 1st May, 2023 and on 12th May, 2023 but none appeared on behalf of the petitioner. Today also even on the second call none appears on behalf of the petitioner. It is found from the record that the petitioner is not interested to proceed with the matter.

Accordingly, CO 1/2022 is dismissed for default.
