Abhijit Roy v. State Of West Bengal
rkd 13.01.2020 Ct. No.28 C.R.M. 208 of 2019 In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 07/01/2019 in connection with Jalpaiguri Women P.S. Case No. 144 of 2019 dated 07/11/2019 under Sections 498A/304B/34 of the Indian Penal Code and under Sections 4 of the D.P. Act. And In the matter of: - Abhijit Roy @ Bubai Roy & Anr. ....petitioners.
Mr. A. Banerjee ...for the petitioners.
Mr. A. Ganguly, Mr. S. K. Dan ...for the State.
Petitioner no.1 has been arrested. Accordingly, the application is dismissed as infructuous.
Having considered the materials in the case diary and bearing in mind the prima facie involvement of the petitioner no.2 in assaulting the victim housewife resulting in her unnatural death within six years of marriage and in view of the gravity of the offence and as the petitioner does not stand on the same footing with the co-accused person who has been granted pre-arrest bail, we are not inclined to grant anticipatory bail to the petitioners. The application for anticipatory bail is, thus, rejected. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
