Minu Khatun v. State Of West Bengal
01.04.2 PG Court No.1 C.R.M. 12 of 2019 Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure, 1973.
In re : Minu Khatun.......... Petitioner Mr. Anirban Banerjee Mr. Debasish Mukhopadhyay...........for the petitioner Mr. Nilay Chakraborty.... ... for the State Apprehending arrest in connection with Banarhat Police Station F.I.R. No. 200 of 2018 dated 30.09.2018 under sections 363/365 of the Indian Penal Code, the petitioner has presented this application for a direction that in the event of such arrest, she may be released on bail.
We have heard the parties and perused the materials in the case diary. Although it is true that the petitioner's husband, who also played a crucial part in convincing the victim to move to Jammu and Kashmir in search of a job has been granted bail, we are not inclined to grant the prayer of the petitioner since we are of the view that custodial interrogation of the petitioner is necessary for tracing out the victim.
Accordingly, C.R.M.12 of 2019 is rejected.
