The present application has been filed for grant of pre-arrest bail to the petitioner in Mathabhanga P.S. Case No.223 of 2020 dated 03.07.2020 registered under Sections 18(b)/20(b)(ii)(A) of the Narcotic Drugs and Psychotropic Substances Act.
It is alleged that the recovery of 16.466 kg of ganja has been made from the house of the petitioner.
The argument sought to be raised by the learned counsel for the petitioner is that nothing was recovered from the petitioner and she has been falsely implicated in connection with the instant case. The house is not owned by her.
This can be a matter of evidence but cannot be appreciated at the stage of grant of pre-arrest bail where recovery of 16.466 kg of ganja has been made from the petitioner.
CRM 25 of 2021 After hearing learned counsel for the parties, in our opinion, no case is made out for grant of pre-arrest bail by this court. The present application is, accordingly, dismissed. (Rajesh Bindal, J.) (Saugata Bhattacharyya, J.)
