Heard learned counsel appearing for the parties. Learned counsel for the petitioner submits that no contraband articles were recovered from the possession of the petitioner and the petitioner has been falsely implicated in the case solely on the basis of the statement of the coaccused persons and the said co-accused persons are already enlarged on bail.

Learned counsel appearing for the State opposes the prayer for bail.

Having considered the materials on record and in the light of the submission made on behalf of he petitioner, we are inclined to grant bail to the petitioner.

Accordingly, the petitioner, namely, Raja @ Ibrahim @ Md. Sadre Alam, shall be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special Court, (NDPS Act) at Siliguri, subject to the condition that the petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner shall not leave the State of West Bengal without prior permission of the court. In the event the petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel the bail in accordance with law without further reference to this Court.

The application, being C.R.M. 27 of 2021, is disposed of.
