Najim Hoque v. State Of West Bengal
13.01.2020 Court No.28 SL No.133 AP CRM 253 of 2020 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 08.01.2020 in connection with Sahebganj P.S. Case No. 571 of 2018 dated 22.12.2018 under Sections 498A/302/304B of the Indian Penal Code and Sections 3/4 of the D.P. Act.
And In the matter of: Najim Hoque ....Petitioner.
Mr. Sudip Guha ...for the Petitioner.
Mr. Amita Gaur for the State.
Having considered the materials on record disclosing prima facie involvement of the petitioner in the murder of his wife and in view of the gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
The application for bail is, thus, rejected.
Keeping in mind the period of detention suffered by the petitioner i.e. about 384 days, we direct the trial court to expedite the trial and conclude the same at an early date preferably within a period of one year from the next date fixed for recording of evidence without granting unnecessary adjournment to either of the parties.
