Mr. Subhajyoti Das ... for the petitioner Mr. Momenur Rahaman, Mr. Sumit Kumar ... for the State Affidavit of service filed in court today is taken on record.

The petitioner who was an Assistant Teacher retired from service on 31.07.2017.

The revised Pension Payment Order was issued on 25.03.2021.

In terms of the revised Pension Payment Order the revised gratuity and revised pension was released in favour of the petitioner on 14.05.2021.

The petitioner claims interest for delayed payment of revised gratuity and interest.

Learned Advocate appearing for the petitioner placed reliance upon an order dated 03.01.2024 passed in WPA 2871 of 2023 wherein this Court directed the respondent authorities to pay interest to the petitioner at the rate of 8% per annum on the revised gratuity and

revised arrear pension calculated on and from 14.02.2020 till the date of actual payment.

In view thereof, WPA 35 of 2024 is disposed of by directing the Director of Pension, Provident Fund and Group Insurance being the respondent no. 2 and the Treasury Officer, Alipurduar being the respondent no. 4 to pay interest to the petitioner at the rate of 8% per annum on the revised gratuity and revised pension calculated on and from 14.02.2020 till the date of actual payment. Such payment is to be made positively within a period of eight weeks from the communication of this order.

Since no affidavit-in-opposition has been called for, the allegations contained in the writ petition shall be deemed to have been admitted by the respondents. There shall, however, be no order as to costs. (HIRANMAY BHATTACHARYYA, J.)
