Kush Mandal v. The State Of West Bengal
07.01.2026
IN THE HIGH COURT AT CALCUTTA
Item No.55 CIRCUIT BENCH AT JALPAIGURI Ct.No.3 dc.
Rejected C.R.M. (A) 10 of 2026 In Re : An Application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Sitalkuchi Police Station Case No. 142 of 2025 dated 04.04.2025 under Sections 20(b)(ii)(c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re :
Kush Mandal ... Petitioner.
Mr. Sourav Ganguly, Mr. Gopal Roy, Ms. Rishita Chakraborty ... For the Petitioner.
Mr. Kallol Acharjee, Mr. Tapan Bhattacharjee ... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been implicated on the basis that he happens to be the owner of the house from where seizure has been effected. However, the learned advocate submits that the said house was sold two years ago.
Learned advocate appearing for the State opposes the prayer for anticipatory bail and submits that 1092.4 kgs. of ganja was recovered and the wife of the petitioner was arrested from the said house.
Considering the facts of the case, I am of the view that this is not a fit case to extend the privilege of anticipatory
bail to the present petitioner. As such, the prayer for anticipatory bail of the petitioner is rejected. The application for anticipatory bail, being CRM (A) 10 of 2026, is, thus, dismissed.
