The present application for grant of bail has been filed by the mother-in-law of the deceased in connection with Cr. Misc Case No.1164 of 2019 corresponding with GR Case No. 461/2019 arising out of Coochbehar Sadar Woman Police Station Case No.23 of 2019, dated 11-05-2019 registered under Sections 498A/307 of the Indian Penal Code, 1860. Offence under Section 302 of the Indian Penal Code was subsequently added as the complaint died. The bail application was earlier rejected by the Principal Bench of this Court vide order dated 10th February, 2020. It has been recorded in the aforesaid order that prima facie there was direct involvement of the petitioner in killing the deceased.

The allegations are that diesel was pored on her by the petitioner and the husband of the deceased and she was set on fire.

C.R.M. 38 OF 2021 Keeping in view of the aforesaid facts and also that the material witness in the trial are yet to be examined, we do not find any case is made out to grant bail to the petitioner at this stage. The application for bail is accordingly, dismissed.
