13.01.2026
IN THE HIGH COURT AT CALCUTTA
Item No.27 CIRCUIT BENCH AT JALPAIGURI Ct.No.3 dc.
Allowed C.R.M. (A) 11 of 2026 In Re : An Application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Sahebganj Police Station Case No. 171 of 2024 dated 25.03.2024 under Sections 448/307/506/34 of the Indian Penal Code read with Sections 9B(2)(b) of the Explosive Substances Act.
And In Re : Pradip Kumar Barman @ Pradip Barman and others ... Petitioners.
Ms. Madhushri Dutta, Ms. Bipasha Mrug ... For the Petitioners.
Mr. A. S. Chakraborty, APP, Dr. Arjun Chowdhury ... For the State.
Learned advocate appearing for the petitioners submits that the petitioners are innocent of the charges and they have been falsely implicated in connection with the instant case because of political vendetta.
Learned advocate appearing for the State has produced the case diary. It has been submitted that the FSL report has corroborated the accusations made by the de facto complainant.
I have taken into account the materials appearing in the FIR and about 68 persons being named. On an assessment of the totality of the facts and the manner in which the investigation has proceeded and culminated to
charge-sheet, at this stage, I am of the view that custodial detention of the present petitioners is unwarranted. As such, the prayer for anticipatory bail of the petitioners is allowed. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of eight weeks from date. The application for anticipatory bail, being CRM(A) 11 of 2026, is, thus, disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
