CIRCUIT BENCH OF CALCUTTA HIGH COURT AT JALPAIGURI 10.02.2021 p.b./rrc C.R.M. 48 of 2021 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Jalpaiguri Women Police Station Case No. 112 of 2020 dated 19.10.2020 under Section 498A of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act.

In the matter of : Mrs. Sanghita Mukherjee & Anr. ... petitioners Ms. Swarnali Saha .....For the petitioners Mr. Nilay Chakraborty Ms. Namrata Das ......For the State Since other family members of the petitioners before us are already on bail and the victim girl and accused no. 1 are presently residing together as submitted by learned counsel for the petitioners, we are of the view that the application for anticipatory bail of the petitioners should be allowed. In the event, the petitioners are arrested, they will be released on bail upon furnishing a bond of Rs.10,000/- with two sureties each of like amount each to the satisfaction of the arresting officer. The petitioners will be subject to Section 438(2) of the Code of Criminal Procedure and make themselves available for questioning before the concerned police station as and when the petitioners are required to do so and upon prior intimation.

CRM 48 of 2021 is allowed and disposed of in terms of the above.
