The present application has been filed for grant of pre-arrest bail to the petitioners, who have been arrayed as accused, in Mathabhanga P.S. Case No.290 of 2019 dated 23.07.2019 registered under Sections 341/307/326/34 of the Indian Penal Code.

The learned counsel for the petitioners submitted that the main accused Sanjib Das has already been arrested and has been granted bail by the learned trial court. The charge-sheet has already been presented. There are no specific allegations against the petitioners. Hence, their custody is not required.

On the other hand, learned counsel for the respondent submitted that it is a case in which the victim has been caused grievous injury with a sharp edge weapon. A part of his large intestine had come out. Even if there is no specific allegation against the petitioners but they were accompanying the accused. Hence, they do not deserve concession of pre-arrest bail.

CRM 49 of 2021 After hearing learned counsel for the parties and considering the kind of injuries which have been inflicted on the victim with a sharp edge weapon where part of his large intestine had come out, we do not find it to be a fit case for grant of pre-arrest bail.
