We have considered the materials on record.

Statements of witnesses and contemporaneous document i.e. seizure memorandum shows recovery of 7.24 kgs. of Yaba Tablets from petitioner. He does not stand on same footing with co-accused who have been released on bail as no recovery was made from them.

Keeping in mind the incriminating materials against the petitioner and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to him. 4.

Accordingly, the prayer for bail of the petitioner is rejected.
