Learned advocate appearing for the petitioner submits that the proceedings under Section 12 of the PWDV Act was filed in the year 2024 and more than 14 months passed since the application was filed before the learned Magistrate. However, because of systemic delays petitioner has been unable to present his case for interim reliefs. Petitioner presently prays for interim relief for residential accommodation. Learned Magistrate would consider if such application is pending or if such application is freshly filed and dispose of the same within a period of two months from the date of filing of the application.

With the aforesaid observations CRR 12 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
