Rahaman... for State Mr. Samir Paul...for Respondent No. 1 The petitioners applied for the post of Anganwari Worker pursuant to the advertisement dated October 22, 2009 issued by the Child Development Project Officer, Tufangaj-II, Cooch Behar.

It is contended that the petitioners appeared for the written test which was held on January 10, 2010. The petitioners received a communication dated July 17, 2010 by which they were informed that they had qualified in the written examination and were directed to appear at the viva voice which was held on July 27, 2010. The petitioners appeared at the viva vocie but the results were not published.

The petitioners further contended that although the employer has a right to cancel a selection process or not give effect to the same, but in this case, no such decision was communicated to the petitioners.

Accordingly, the petitioners made a representation before the District Magistrate, Cooch Behar who is in-charge of the supervising such project praying for information as to why the result of the alleged selection process was not published. The District Magistrate and the other authorities, before whom the petitioners have approached, remained silent.

Under such circumstances, this writ petition is disposed of with a direction upon the District Magistrate concerned to dispose of the representation of the petitioners dated November 05, 2013 which is annexed at page 28 of the writ petition in accordance with law and by passing a reasoned and speaking order dealing with the averments contained in the representation and such order should be communicated to the petitioners.

The entire exercise should be completed within two month from the date of communication of this order.

The writ petition is accordingly disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon observance of requisite formalities.
